MM&H represents Anthony Ruben, a real estate investor with extensive experience in complex finance and commercial real estate investing. In April 2018, Mr. Ruben was recruited by the CEO and founder of a private real estate investment trust, DLP (short for “Dream Live Prosper”), to scale its investment platform. Working 80+ hour weeks, Mr. Ruben took DLP from a $200 million fund to a $2 billion REIT over the course of his three and a half-year tenure with DLP. Mr. Ruben’s compensation was tied to transaction and promote fees (generally twenty percent of profits earned over a preferred return on capital managed). When those fees monetized pursuant to Ruben’s investment theses, DLP terminated him pretextually to avoid paying millions of dollars of accrued compensation. The complaint asserts claims for breach of contract, breach of the implied covenant of good faith and fair dealing, declaratory relief and an accounting. As the case neared the end of discovery, the parties entered into an extremely favorable settlement for MM&H's client.
