This dispute concerns the redevelopment of a historic hotel located in Miami Beach, FL. The property was originally constructed in 1948 as a 102-room hotel. The redevelopment project was intended to fully modernize the hotel and add adjacent commercial retail space and parking. However, the general contractor, architect and engineers collectively failed to adequately design and construct the property and failed to contemplate and appreciate the foreseeable challenges required in a historic property renovation. The project is still incomplete and is currently $9 million over budget. Mark Migdal & Hayden has been engaged by the Developer to recover the damages resulting from the ongoing construction delays, defects and deficiencies.
