MM&H was retained by one of Miami’s leading restauranteurs to lead a cross-border effort to recover a substantial Panamanian trust being mismanaged by an interested fiduciary. MM&H have coordinated with Panamanian counsel in a two-pronged approach to ensure the proper, intended distribution of the multi-million-dollar trust took place. First, MM&H laid the foundation for filing a legal action in the U.S. for the purpose of freezing the Trust’s U.S. assets by having the U.S. Court interpret and apply Panamanian law. Second, using that potential suit as leverage MM&H was able to bring all beneficiaries of the trust- each with their own disparate interests- to the table, along with the Panamanian trustee to facilitate the distribution of the trust, as originally was intended by the Trust’s creator prior to their passing away.
